1. Definitions
- “Company” refers to J&T Hire.
- “Customer” refers to the individual or entity hiring equipment from the Company.
- “Equipment” includes all items provided on hire by the Company to the Customer.
- “Hire Period” refers to the duration for which the Equipment is hired, as specified in the hire agreement.
- “Hire Charges” means the fees payable by the Customer for the hire of Equipment.
2. Hire Agreement
2.1. A hire agreement is formed when the Company provides a hire schedule to the Customer, outlining the Equipment hired, Hire Period, and applicable Hire Charges.
3. Hire Charges and Payment
3.1. The Customer agrees to pay the Hire Charges as specified in the hire schedule.
3.2. Payment terms are as agreed upon in the hire agreement. Late payments may incur additional charges.
4. Delivery and Return of Equipment
4.1. The Company will provide the Equipment in good working order at the commencement of the Hire Period.
4.2. The Customer is responsible for returning the Equipment in the same condition, fair wear and tear excepted, at the end of the Hire Period.
5. Customer Responsibilities
5.1. The Customer must use the Equipment in a proper, safe, and lawful manner, following any instructions provided by the Company.
5.2. The Customer is responsible for any loss or damage to the Equipment during the Hire Period.
5.3. The Customer must not on-hire the Equipment to any third party without the Company’s prior written permission.
6. Maintenance and Repairs
6.1. The Customer must notify the Company immediately of any breakdowns or defects in the Equipment.
6.2. The Customer must not attempt to repair the Equipment without the Company’s consent.
7. Insurance
7.1. The Customer is responsible for insuring the Equipment against loss, theft, or damage during the Hire Period.
8. Liability
8.1. The Company is not liable for any indirect or consequential loss arising from the use of the Equipment.
8.2. The Company’s total liability is limited to the Hire Charges paid by the Customer.
9. Termination
9.1. The Company may terminate the hire agreement immediately if the Customer breaches any terms or becomes insolvent.
9.2. Upon termination, the Customer must return the Equipment promptly.
10. Governing Law
10.1. These terms and conditions are governed by the laws of Australia.
11. Amendments
11.1. The Company reserves the right to amend these terms and conditions at any time. Any changes will be communicated to the Customer in writing or via the Company’s website.
